Inherited property valuation in Surat

In Surat an inheritance often includes a business premises as well as a home: a shop in a market, a unit in an industrial estate, a share in family land. Each has to be valued properly before the family can divide it.

Homes, shops and land are valued differently

A flat is valued from sales in the same building and area. A shop is valued from sales and rents in the same market, where the floor and frontage matter more than the area. Land is valued from its tenure, access and use. Families that divide by area alone often find the shares are nowhere near equal.

Changing the records

A city property passes to the heirs through the municipal record and, where relevant, the society's register. Land passes through a mutation entry on the 7/12. Gujarat does not require probate of a will, unlike Mumbai, but the offices will need the will or the consent of every legal heir.

Two dates

The value on the date of death settles the division. The 1 April 2001 value or the original cost decides the tax on a later sale. We give both after one inspection.

A plot inside a town planning scheme

If the inherited land sits in a town planning scheme, the heirs inherit the final plot, not the original one. Any deduction or contribution the scheme imposed affects the value, and the report traces the original plot to the final plot so every heir sees the same thing.

Surat inheritance questions

Do we need probate in Gujarat?

No. Probate is compulsory for wills in Mumbai, Chennai and Kolkata, not in Gujarat. The records offices still need the will or the consent of all heirs.

One brother runs the family shop and wants to keep it. How is that settled?

Value the shop independently, then he pays the others their shares. Our buyout calculator shows what each would receive.

The land is new tenure. Does that reduce its value?

Usually, by about the premium that has to be paid before non agricultural sale. The report states it so every heir sees the same figure.
