Property valuation for court matters in Surat
Surat disputes often involve business partners as well as family, and premises as well as homes. A valuation for court has to treat each kind of property on its own terms, and show its working so the court can rely on it.
The disputes we are asked into
- Dissolution of a partnership that owns shops, offices or industrial units.
- Family partition of homes and business premises together.
- Town planning scheme disputes, over the size or position of a final plot or the deduction taken.
- Land acquisition claims, where the compensation offered is challenged.
Cases begin in the Surat courts. Appeals go to the Gujarat High Court in Ahmedabad.
Commercial property needs rental evidence
A shop or office is worth what it earns as much as what it would sell for. For partnership and business disputes, we present both: comparable sales and the rental value capitalised at a rate the market supports. The court sees two methods, and how close they come.
Land acquisition and compensation
Where land is acquired for a road, a rail line or an industrial project, the compensation turns on the market value at the date the law specifies. We value as at that date from the jantri and registered sales of the time, and set out the comparable sales so the court can test them.
Retrospective values
Partnership and family disputes often need a value as at the date of dissolution or the date of death, not today. The report states the valuation date on its face, and every piece of evidence is from around that date.
Surat court valuation questions
- Can you value the property of a partnership being dissolved?
Yes. We value each property the firm owns and set them out separately, so the settlement can be worked out from clear figures.
- The TP scheme took more of my land than it should have. Can you help?
We can establish the original plot, the final plot and the value of the difference. Whether the deduction was lawful is for the court.
- Will the valuer attend court?
Yes, if needed. The valuer who signed the report can appear and explain it.
