Capital gains valuation in Surat

Surat grew enormously after 2001, and property bought before then is now worth many times its price. A certified value as on 1 April 2001 is how the taxable gain is brought back to a fair figure.

The 2001 value

For property acquired before 1 April 2001, its value on that date can be used as the cost. For Surat property, the evidence comes from the jantri of the time and registered sales in the same area. For a plot in a town planning scheme, the scheme's records of the plot as it then stood are added.

The town planning scheme matters here. If your original plot became a smaller final plot after 2001, the report values what you held in 2001, and records the change, so the computation matches the property you actually sold.

Selling agricultural land

Agricultural land outside the distance limits set by the tax law is not a capital asset, so its sale may not be taxed at all. Inside those limits, it is taxed like any other property. The report records the land's location and the 7/12 entries so your CA can decide which applies.

If the land was new tenure and a premium was paid to convert it, that premium may form part of the cost, which reduces the gain.

Shops and commercial premises

Many Surat sellers are disposing of business property: a shop in a textile market, a unit in an industrial estate. These are valued from sales and rents of comparable premises, and the report sets out the evidence.

Surat capital gains questions

My plot was reshaped by a TP scheme after I bought it. Does that matter?

Yes, for working out what you held at each date. The report traces the original plot to the final plot so the cost and the sale match.

Is the premium paid for new tenure conversion part of my cost?

It can be, as a cost of improving the asset. We record the payment so your CA can include it.

The jantri went up a lot in 2023. Does that affect my 2001 value?

No. The 2001 value is based on 2001 evidence. The 2023 jantri matters only for stamp duty and for checking the sale price today.
