What makes a report survive court
Judges in Mumbai see valuations weekly and they know padding when they see it. A report survives when the method is standard, the comparable sales are real and registered, the inspection is documented with dated photographs, and the valuer can stand in the box and defend every line. That is the standard we write to, and we do appear when called.
Valuation as on a past date is common in litigation. The dispute may fix value at the date of filing, the date of a family event or a date decades back. We reconstruct past values from the ready reckoner archive and period sale records, and we say plainly in the report how it was done.
Questions from Mumbai litigants and lawyers
- Can both sides appoint you jointly?
Yes, and it is usually the smart move. One joint report costs less than two partisan ones and settles most matters faster. Courts also receive a joint valuation better.
- The property is a pagdi tenancy. Can its value be proved?
Yes. Mumbai courts deal with tenancy value all the time, and there are accepted approaches for it. The report explains the approach in words a judge can quote.
- Will you appear for cross examination?
If the matter requires it, yes. A report you cannot defend in person is not worth filing, so we only sign what we can stand behind in the witness box.
