Property valuation for court matters in Chandigarh
The Punjab and Haryana High Court sits in Chandigarh, so property disputes from across two states end up here, alongside the city's own. A valuation for court has to show its working so plainly that a judge can follow it and the other side cannot pick it apart.
The disputes we are asked into
- Partition of a family house, made harder in the older sectors because the house cannot be split into apartments, so the court is usually choosing between a sale and a buyout.
- Leasehold disputes, over unauthorised transfers, resumption by the administration, or the amount payable on transfer.
- Appeals from Punjab and Haryana, where the property may be anywhere in either state.
- Matrimonial matters involving a jointly owned house or flat.
The leasehold question a court will ask
In most cities a court values a house and stops. Here it also has to know what a buyer would owe the administration to take the house over. A leasehold house that needs permission and a payment before transfer is worth less to a buyer than a freehold one next door, and the report puts a figure on that difference.
Courts in Chandigarh also see a lot of sector houses with later additions. We separate what stands lawfully on the plan from what was added without approval, because a court dividing an estate usually needs both numbers.
Chandigarh court valuation questions
- Can you value a property in Punjab for a case in the High Court here?
Yes. We inspect wherever the property is and value it under that state's rules and evidence. The report states the jurisdiction clearly.
- The court wants the value from years ago. Is that possible?
Yes. A retrospective valuation uses collector rates, registered sales and the condition of the property at that date, and says so on its face.
- Does a leasehold house get a lower value in a partition?
Its market value reflects what a buyer must pay to complete the transfer, so usually yes, by about that amount. The report shows the calculation so every party can see it.
