Property valuation for court matters in Nagpur
Nagpur has its own bench of the Bombay High Court, so property appeals from across Vidarbha are argued here. A valuation for any of those cases has to show what was valued, at what date, and from which evidence.
The disputes we are asked into
- Partition of a family house, plot or farmland.
- Layout disputes, where the same plot was sold twice in an unapproved layout, or boundaries in the layout plan do not match the ground.
- Land acquisition compensation, where the amount offered is challenged.
- Matrimonial matters involving a jointly owned home.
Plots need measuring, not just valuing
In a layout dispute, the report records the plot as it appears in the layout plan, in the records and on the ground, and states any difference. A court cannot decide who owns what share of a plot if nobody has established how big the plot actually is.
Where the case concerns compensation, the value is taken as at the date the law specifies, from ready reckoner rates and registered sales of that time, and the report says which date and why.
Retrospective values
Cases in Nagpur often run for years, and the court may need a value as at the date of filing, the date of a partition, or the date of a sale being challenged. We value at that date from the ready reckoner and registered sales of the time, and state the date on the face of the report.
Nagpur court valuation questions
- Can you value land for a compensation appeal?
Yes. We value as at the relevant notification date from evidence of that period, and set out the comparable sales the court can test.
- Two people hold sale deeds for the same plot. Can you help?
We do not decide title, which is for the court. We can establish the plot on the ground and its value, which the court needs whichever way it decides.
- Will the valuer give evidence at the High Court bench?
Yes, if the case calls for it. The valuer who signed the report appears and explains it.
