Inherited property valuation in Gurugram
An inherited Gurugram property is often worth far more than the family expects, and often split across more than one floor or more than one heir. A signed valuation is how everyone agrees on what there is before anyone agrees on who gets what.
How inheritance works on paper here
Haryana does not require a will to be probated before the property passes, unlike Mumbai, Chennai or Kolkata. What it does require is that the transfer is recorded with whoever holds the record.
- An HSVP sector plot is transferred to the heirs by the authority, on the basis of a will, a succession certificate or the consent of all legal heirs.
- Land and village property moves through mutation in the jamabandi at the tehsil.
- A licensed colony property follows the sale deed chain, and the municipal record is updated.
The valuation does not depend on which of these applies, but the report records the route, because the family will need it.
Dividing a builder floor house
The most common Gurugram family file is a house rebuilt as floors, with one floor each for several children. The floors are rarely worth the same. The ground floor often carries a garden or parking, the top floor carries the roof, and the middle floors carry neither. A fair split values each floor on its own, not the house divided by the number of heirs.
Why the date matters
For a later sale, the heirs' cost is tied to the original owner's. If that owner held the property before 1 April 2001, the 2001 value can be used, and in Gurugram that can change the tax bill by a large amount. We usually value at both dates in one report.
Gurugram inheritance questions
- Do we need probate in Gurugram?
No. Probate is required for wills in Mumbai, Chennai and Kolkata, not in Haryana. The HSVP transfer or the mutation still needs the will or the consent of all legal heirs.
- Three of us inherited one house split into floors. Are the floors equal?
Almost never. Garden, parking, roof rights and floor level all move the value. We value each floor separately so the division is fair and can be shown to be fair.
- Our father bought the plot in 1985. Which value do we need?
Usually two: the value on the date of his death for the division, and the 1 April 2001 value for any later sale. One inspection covers both.
