Circle Rate vs Market Rate

Two different numbers for the same property, and people mix them up constantly. Here is the difference and why it matters.

Circle rate

A minimum value set by the government for each area. Stamp duty is charged on it, and you cannot register a sale below it. It is a floor, not an opinion of worth.

Market rate

What the property would actually sell for, between a willing buyer and a willing seller. This is what a valuation report establishes.

Why they differ

Circle rates are revised occasionally, sometimes after long gaps. Markets move continuously. In Delhi many colony rates have stood for years while actual prices moved well past them.

So in most established areas the market rate sits above the circle rate, sometimes far above.

When circle rate is higher

It happens, usually in areas where prices fell after the rates were set, or where a specific property has a problem such as poor access, a long standing tenant or a legal dispute.

This creates a practical difficulty. You must still register at the circle rate and pay duty on it, even though you sold for less, and the difference can have tax consequences for both sides. Speak to your accountant before agreeing such a sale.

Which one goes in a valuation report

Both, and that is the point. A proper report states the notified rate as evidence, then explains the market position with reference to actual sales, and reconciles the two.

A report that only quotes the circle rate is not really a valuation. It is a lookup anyone could do. You can do it yourself here.

Questions people ask us

Which is used for my capital gains tax?

Your gain is generally computed from actual sale consideration, but where the declared price is below the circle rate, rules can substitute the higher figure. This is exactly why under declaring is a bad idea.

Can I use the circle rate as my 2001 value?

The 2001 notified rate is important evidence but usually not the whole answer, because market prices in 2001 often differed from notified rates. A proper valuation uses both.
